Liability Waiver
People In Motion Pte. Ltd. (trading as "The Yard")
Effective from: 2 June 2026
Last updated: 2 June 2026
This waiver must be signed by every participant (or, in the case of a minor, by the participant's parent or legal guardian) before participating in any class, event, or activity at The Yard.
1. Assumption of risk
Gymnastics and the related activities offered by People In Motion Pte. Ltd., trading as "The Yard" — including but not limited to recreational gymnastics, competitive gymnastics, ninja-style obstacle activities, tumbling and trampoline, adult open gym, parties, camps, showcases, and competitions — are physical activities that carry inherent risks of injury.
Risks include but are not limited to:
- Cuts, bruises, sprains, and strains
- Falls
- Possible fractures
- Injuries to limbs, back, head, and neck
- Aggravation of pre-existing medical conditions
By signing this waiver, you knowingly, voluntarily, and freely accept and assume any and all such risks on behalf of yourself (if an adult participant) or on behalf of your child (if a parent / legal guardian).
2. Release of liability
To the fullest extent permitted by law, you (the participant or parent / legal guardian) release, discharge, and agree to hold harmless People In Motion Pte. Ltd. (trading as "The Yard"), its directors, employees, contractors, coaches, agents, and the owners and occupiers of the premises at which classes and events are held, from any and all claims, demands, actions, causes of action, costs, expenses, and liabilities arising out of or related to participation in The Yard's activities — except where the law does not permit such release (for example, in cases of gross negligence or wilful misconduct).
You acknowledge that this release is given freely, with full understanding of its meaning, and not as a result of any misrepresentation by The Yard.
3. Medical fitness and disclosure
You certify that the participant is in good physical condition and has no medical condition that would preclude safe participation in The Yard's activities. If there are any medical conditions, allergies, recent injuries, medications, or other safety-relevant matters, you agree to disclose them to The Yard in full when signing this waiver (see Section 7 — Information We Collect).
You authorise The Yard to:
- Take any reasonable action it considers necessary in the event of a medical emergency, including calling emergency medical services.
- Share relevant medical information (allergies, conditions, medications, emergency contact details) with paramedics, hospitals, or treating clinicians as necessary in an emergency.
You agree to cover any and all medical expenses incurred for treatment of the participant in connection with their participation in The Yard's activities, including any expenses arising from emergency response on the participant's behalf.
4. Parental authority (for participants under 18)
If the participant is under 18 years of age, the parent or legal guardian signing this waiver:
- Confirms that they have full legal authority as parent or legal guardian to consent on the participant's behalf
- Has read, understood, and agrees to all terms of this waiver
- Accepts responsibility for the medical expenses, conduct, and supervision (outside of class time) of the participant
- Authorises The Yard's coaches and staff to give reasonable direction and care to the participant during classes, events, and activities
If both parents have legal authority and there is any dispute as to consent, The Yard will be entitled to rely on the consent of the signing parent / guardian until notified otherwise in writing.
5. Photography and video consent
From time to time, photographs and videos are taken at The Yard's classes, events, showcases, and competitions. Please indicate the level of consent you give for the use of images of yourself or your child by ticking the applicable boxes when you sign this waiver:
You will be asked, when completing the waiver form, to indicate the level of consent you give for photography and video use. The options offered are:
- Internal records only — coach review, class assessment, parent updates.
- Social media — The Yard's Instagram, Facebook, TikTok, or similar platforms.
- Website and printed marketing materials — brochures, advertisements, partner publications.
- None — no use beyond what is necessary for safety (e.g. incident review).
You may withdraw any previously-given consent at any time by emailing dpo@theyard.com.sg. Withdrawal applies prospectively — content already published may not always be retrievable, but we will cease further use.
6. Code of conduct
By participating, you agree (on your own behalf or on behalf of the child) to:
- Follow the reasonable instructions of The Yard's coaches and staff at all times
- Treat coaches, staff, other participants, and the premises with respect
- Disclose any change in medical condition or fitness for participation that arises between signing this waiver and any class or event
- Not participate while under the influence of alcohol or non-prescribed drugs
- Not bring food containing nuts onto the premises (The Yard is a nut-free environment for the safety of children with allergies)
The Yard reserves the right to suspend or terminate participation, without refund, in the case of material breach of this code of conduct or any conduct that endangers other participants.
7. How long we keep this data
Waiver records for children are retained until the child reaches 25 years of age, or 7 years after the child's last enrolment, whichever is later. Waiver records for adults are retained for 7 years after the adult's last enrolment. After these periods we delete or anonymise the data, unless we have a continuing legal obligation to retain it. These retention periods reflect the limitation periods under Singapore law for personal injury claims.
